1. OVERVIEW

Welcome to Pretty Savage.

Pretty Savage is a South African apparel and lifestyle trading name operated as a sole proprietorship.

These Terms of Service govern your access to the Pretty Savage website and purchases made through our online store.

Throughout these Terms:

“Pretty Savage”, “we”, “us” and “our” refer to Pretty Savage; and

“you”, “your” and “customer” refer to the person accessing the website or purchasing our products.

By accessing our website or placing an order, you agree to these Terms together with our:

Cancellation Policy
Shipping & Delivery Policy

Nothing in these Terms is intended to waive, exclude or restrict a consumer right that cannot lawfully be excluded under South African law.

2. WEBSITE & ONLINE STORE USE

You may use this website only for lawful purposes.

By placing an order, you confirm that you are legally capable of entering into the transaction or have any consent legally required to do so.

You may not use the website, products, payment facilities or services for unlawful, fraudulent or abusive purposes.

3. PRODUCTS

Pretty Savage sells apparel and related lifestyle products, including embroidered garments and limited-production products.

We make reasonable efforts to display:

Product designs
Colours
Embroidery
Garment details
Sizing
Pricing
Product descriptions

as accurately as reasonably possible.

Colours may nevertheless appear differently because of individual screen settings, lighting and differences between physical thread, fabric and digital images.

Minor embroidery variations may occur and do not automatically constitute defects.

4. SIZING & FIT

Pretty Savage garments may be designed with an oversized or intentionally relaxed fit.

Customers should review the product description, size guide and measurements before ordering.

The customer remains responsible for selecting their preferred size, subject to statutory rights and our Returns, Exchanges & Refund Policy.

5. PRICING

Prices are displayed in South African Rand (ZAR) unless otherwise stated.

Delivery charges are displayed separately before checkout.

Pretty Savage may change prices before an order is placed.

Where an obvious pricing or technical error occurs, we reserve the right to correct the error and will deal with any affected order fairly and in accordance with applicable law.

6. PAYMENT

Payment must be made using a payment option offered during checkout.

Payments may be processed by authorised independent third-party payment providers.

Their own terms, conditions and privacy practices may apply to the payment service they provide.

Pretty Savage does not directly store full card information where such information is securely processed by an authorised payment provider.

An order will proceed once the required payment or payment authorisation has been successfully confirmed.

7. ORDER CONFIRMATION

After placing an order, you should receive an electronic confirmation.

Receipt of an automated confirmation does not prevent Pretty Savage from contacting you where:

Payment cannot be verified;
An item has unexpectedly become unavailable;
A clear pricing or technical error occurred;
Fraud or misuse is reasonably suspected; or
Fulfilling the order would be unlawful.

Where Pretty Savage lawfully cancels an order after payment has been received, amounts due to the customer will be refunded in accordance with applicable law.

8. STOCK AVAILABILITY

Products, colours and sizes are subject to availability.

Although we take reasonable steps to keep stock information accurate, occasional discrepancies may occur.

If a product becomes unavailable, Pretty Savage will contact the customer and provide an appropriate solution in accordance with applicable law.

9. PRE-ORDERS & LIMITED PRODUCTION

Certain Pretty Savage products may be sold on a:

Pre-order,
Limited-production, or
Embroidered-to-order basis.

These products are not immediately available for dispatch.

The estimated production or fulfilment period will be displayed on the relevant product page or communicated to the customer before purchase.

By purchasing the product, the customer acknowledges and agrees to the disclosed production period.

Production estimates may occasionally be affected by manufacturing, embroidery, supplier or other operational delays.

Where a material delay occurs, Pretty Savage will communicate with affected customers and provide the options required by law.

A standard Pretty Savage pre-order product is not automatically considered individually personalised merely because production begins after an order is placed.

10. PERSONALISED GOODS

Where Pretty Savage accepts an order specifically made to an individual customer's specifications, personalised cancellation or return rules may apply where permitted by law.

Personalisation may include individual names, custom wording, individual measurements or other customer-specific modifications.

The applicable terms will be communicated before accepting such a custom order where reasonably necessary.

11. SHIPPING & DELIVERY

Delivery options, rates and estimated timeframes are set out in our Shipping & Delivery Policy and displayed at checkout where applicable.

Customers are responsible for providing accurate delivery and contact information.

Pre-order production time and courier delivery time are separate.

12. RETURNS, COOLING-OFF RIGHTS, CANCELLATIONS & REFUNDS

Returns, exchanges, statutory cooling-off rights, cancellations and refunds are governed by our:

Cancellation Policy, and
applicable South African legislation.

Nothing in these Terms excludes statutory rights relating to defective, unsafe, unsuitable or incorrectly supplied goods.

13. PROMOTIONS & DISCOUNT CODES

Promotions may be subject to additional terms.

Unless otherwise stated:

Discount codes have no cash value;
Only one promotional code may be applied per transaction;
Promotions may be limited by time, stock or product; and
Pretty Savage may amend or withdraw a promotion where reasonably necessary and legally permitted.

Statutory consumer rights remain unaffected.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, Pretty Savage's:

Brand name
PS monogram
Logos
Original graphics
Product artwork
Photographs
Product descriptions
Website content
Original creative designs

are owned by or licensed to Pretty Savage and are protected to the extent provided by applicable intellectual-property law.

They may not be copied, reproduced, commercially exploited or used to manufacture competing products without appropriate permission except where permitted by law.

Purchasing a Pretty Savage product does not transfer intellectual-property ownership in the artwork or branding appearing on that product.

15. PROHIBITED CONDUCT

You may not use the website to:

Commit fraud or other unlawful activity;
Interfere with website security;
Introduce malware or harmful code;
Attempt unauthorised access to systems or information;
Abuse payment or promotional systems;
Violate another person's rights; or
Commercially exploit Pretty Savage intellectual property without permission.

16. THIRD-PARTY SERVICES

Pretty Savage uses third-party services including Shopify, payment providers, couriers and other service providers.

Pretty Savage does not control every aspect of an independent third-party service.

Where applicable, the customer's relationship with such provider may also be governed by that provider's own terms and privacy policy.

17. PERSONAL INFORMATION

Pretty Savage processes personal information in accordance with our Privacy Policy and applicable South African data-protection law.

Information may be shared with appropriate service providers where reasonably necessary for:

Payment processing
Order fulfilment
Delivery
Customer service
Fraud prevention
Legal compliance

18. WEBSITE AVAILABILITY

We aim to maintain an accurate and accessible website but cannot guarantee uninterrupted access.

Maintenance, technical problems, internet disruption, Shopify outages or other circumstances may occasionally make the website unavailable.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pretty Savage is not responsible for indirect or consequential loss arising solely from circumstances beyond our reasonable control.

Nothing in these Terms excludes liability or consumer rights where exclusion would be prohibited by law.
